TERMS OF SERVICE

These Terms govern your use of andbery.com and everything we sell through it. The site and its products are operated by Andrei Beresnev, trading as Andbery. Please read them before subscribing or buying.
1. Agreement
By subscribing to, purchasing, or using any of our Services, you agree to these Terms. If you don't agree, don't use them.
2. What Membership Includes
Real Cinematography membership gives you, for as long as your subscription is active:
- The full course library, including every lesson and guidebook available at the time
- The TeelReel LUT pack and its accompanying files
- Every new lesson published while you're a member
- Live reviews of members' work
- Access to the members' community
Some material unlocks on a schedule rather than all at once. Live sessions run at announced times and are recorded where possible, but we can't promise a time that suits every time zone.
3. Free Trial
New members may be offered a seven-day free trial. We collect payment details when the trial starts, but nothing is charged during it. If you don't cancel before the seventh day ends, your membership begins and the annual fee is charged. One trial per person.
4. Billing and Renewal
Membership costs $297 USD a year and renews automatically until you cancel.
Your card is charged the day the trial ends, and on the same date each following year. We send an email reminder before every renewal charge. If we change the price, we'll tell you at least 30 days before it applies to you, and you're free to cancel before it does. Payments are handled by Stripe and PayPal; we never see or store your card details.
5. Cancelling
You can cancel any time from your account. You don't need to email us or give a reason.
Cancelling stops future charges. You keep access until the end of the period you've already paid for. We don't refund the unused part of a year you've cancelled — that's what the notice period and the trial are for.
6. Refunds
Cancel during the trial and you're charged nothing at all.
After any charge, you have 14 days to ask for a refund and we'll return it in full. After 14 days, that charge is final. Write to [email protected]; refunds go back to the original payment method within 10 business days.
7. If You Bought a Course Before Membership
If you bought Modern Cinematography, the TeelReel LUT pack, or a guidebook as a one-off purchase before [дата перехода], nothing here takes that away.
You keep permanent access to what you paid for, exactly as promised when you bought it. You don't need to subscribe to keep it. What you don't get without membership is the new monthly lessons, the live reviews, and the community — those exist only inside the subscription, and one-off courses are no longer updated.
8. What You Can Do With the Materials
You get a personal, non-transferable licence to use the content for your own learning — while your membership is active, or permanently for one-off purchases covered by Section 7.
You may not share, resell, reproduce, or publicly display the content, redistribute downloaded files, share your login, or use the materials to teach a class or group without written permission.
The LUTs, PowerGrades, and practice footage are different: use them freely in your own commercial and personal work. You just can't resell them, repackage them, or distribute them as your own product.
9. Work You Post
Anything you post in the community stays yours.
By posting it, you allow us to show it inside the community and to discuss it during live reviews, including in recordings of those reviews. We will not use your work on the website or in any promotional material without asking you separately and getting your agreement.
You confirm you have the right to post what you post, including any permission needed from clients or from people who appear in the footage.
10. How to Behave in the Community
This is a room for people who work with a camera, and we expect people to act accordingly.
We may remove content or suspend access without refund for harassment, hate speech, spam, self-promotion unrelated to the craft, sharing paid materials outside the community, or anything illegal.
Feedback in reviews is honest opinion given in good faith. Post work only if you're ready to hear a straight assessment of it.
11. What We Don't Promise
We don't guarantee any particular outcome — no specific skill level, job, client, or income. What you get out of this depends on your own work and circumstances. Everything is provided as is and as available, without warranties of any kind.
We aim to keep everything running continuously but can't guarantee uninterrupted access, and scheduled sessions occasionally move.
12. Limitation of Liability
To the fullest extent the law allows, we're not liable for indirect or incidental damages, lost profits or business opportunities, data loss, or claims arising from your use of the Services.
Our total liability for any claim is limited to what you paid us in the twelve months before that claim arose.
13. Indemnification
You agree to cover us against any claim, liability, or expense arising from your use of the Services, your breach of these Terms, or your infringement of anyone else's rights.
14. Intellectual Property
Everything we provide — videos, guidebooks, LUTs, PowerGrades, graphics, text, logos, and names — belongs to us. Unauthorised use, copying, or redistribution can end your access without refund and may lead to legal action.
15. Ending Access
We may suspend or end your access if we believe you've breached these Terms or engaged in fraud, abuse, or illegal activity. Where we end access for a breach, no refund is given.
If we shut the membership down entirely, we'll refund the unused part of your current year.
16. Governing Law and Disputes
These Terms are governed by the laws of England and Wales. Any dispute will be settled by binding arbitration under the rules of the London Court of International Arbitration. You waive any right to a jury trial or class action.
Nothing here removes a consumer right you hold in your own country that can't be waived by agreement.
17. Changes
We may update these Terms. If a change affects price, billing, or your rights, we'll email you at least 30 days before it takes effect. Continuing to use the Services after that means you accept the new version.
